Generics - Return Goods Policy  

Lupin Pharmaceuticals, Inc (LPI) requires a completed, pre-approved Return Goods Authorization Form (“RGA Form”) for all returns.  LPI will only accept returns from customers who have purchased products directly from Lupin.  This policy is subject to the laws within the governing jurisdiction of the customer.

Returnable Items:

Authorized returns include the following manufacturer’s label code only #68180.
Product with less then 6 months remaining shelf life.
Expired products that are not more than 12 months past expiration date.
Concealed damage claims made within 10 days of receipt.
Products that have been damaged in transit with a signed BOL noting the damage and where Lupin has been notified within five (5) business days from the date of receipt and returned within 30 days.
Products shipped in error on the part of Lupin Pharmaceuticals provided Lupin Customer Service is notified of the error within five (5) business days of receipt.

Non-Returnable Items:

Products without a Return Goods Authorization (RGA) form.
Products with more than six (6) months remaining shelf life.
Products retained more than twelve (12) months beyond expiration date.
Private Label products or repacked goods.
Products with missing label or with missing lot number and expiration date or products marked, coded or adulterated in any way.
Products sold on a non-returnable basis.
Products sold as free goods or products provided at no charge for promotional incentives, samples or short-dated products sold as such.
Products damaged due to insurable causes such as fire or natural disasters, or if damaged/deteriorated due to improper handling or storage by the customer.
Products involved in distressed, sacrifice, fire or bankruptcy sale.
Returns made after 60 days from the date of the RGA.
Overstock, unless agreed by LPI in writing.
Products not purchased directly from LPI.
Products purchased or distributed contrary to federal, state or local laws.

Transportation:

Transportation charges on all returned goods are the responsibility of the customer except when due to a LPI error, as determined by LPI.
Merchandise cannot be sent via US Mail. It must be traceable in the event a package is lost in transit.

Third Party Processing:

Third party processors must comply with all requirements of LPI’s Return Good Policy.
Third party processors must provide proof of destruction for short / outdated product.
LPI will not accept returns from third party return processors for customers other than wholesalers or warehousing chains or other direct purchasers of LPI product, unless a pre-approved contract is agreed to and signed.
All returns from non-authorized customers sent to third party return processors will be refused.
LPI will not process returns using pricing from the third party’s internally generated price list.
LPI will not reimburse any service fees to the customer of processing agent for the miscellaneous fees (i.e., handling, processing fees) or freight charges incurred.
Third party returns must be in compliance LPI’s RGA Form.

Terms of Policy:

Lupin will issue credit for returns at the lower of the current contract selling price or the original invoiced price, adjusted for discounts, rebates, allowances, bill backs, shelf stocks adjustments, etc. No cash refunds will be processed.
Full bottles will be issued full credit.
Partial bottles will be issued partial credit and calculated by rounding up to the nearest quarter and reported in 10, 25, 50 and 75 percent of a full package.
Product must be returned with an approved Return Goods Authorization (RGA) form.  Lupin reserves the right to destroy all returns without an RGA, without recourse.
Lupin will not accept deductions from invoices from returns but will issue a credit memo. Please do not make any deductions from remittances in anticipation of credit.
Return good credit must be taken within one year of date of issue.
Proof of return is the customer’s responsibility.

Procedure for returning goods:

A Return Goods Authorization (RGA) form is required for return of a product. Contact Lupin Pharmaceuticals Customer Service via telephone at 866-587-4617 or via fax 866-587-4627 to request a Return Goods Authorization (RGA) form and approval to return goods. When the return is approved, the RGA form will be provided to the customer via fax. Customer must detail the NDC number, product description, quantity, lot number and expiration date as well as the reason for the return to Customer Service. Customer Service will provide complete shipping instructions with the RGA form. A completed RGA form must accompany all returns.

Disclaimers:

Lupin Pharmaceuticals does not pay or reimburse fees incurred for the processing of or destruction of products processed through a third party returns processing company.
Products that do not qualify for credit or reimbursement will be destroyed and not returned to the customer. Customer will be notified of non-credited items.
Lupin Pharmaceuticals reserves the right to change or update this policy upon written notice to customers.
